Queensland Civil and Administrative Tribunal President Justice Kerri Mellifont today issued QCAT Practice Direction No.8 of 2022 – Applications for review of decisions made about animals.
The practice direction outlines a new procedural approach being taken by QCAT to reviews of a decision made by local government or council, under the Animal Management (Cats and Dogs) Act 2008 (Qld).
It includes information to help parties understand the process, including:
- A conference (shorter duration than the traditional type of conference) will be held in animal matters at an early stage in the process where a QCAT decision maker will inform the parties of their obligations and responsibilities to progress the matter to finalisation. It will also help the parties understand QCAT’s processes and identify the issues to be determined.
- A pre-final hearing directions hearing will be conducted to confirm with the parties the matter is ready for final hearing.
